Terms of Service

Please Read the Following Terms Carefully​

Billing:

Charge Details: $XXX will be charged to the card on file ending in per contract agreement. These charges are set up on auto renew (for group programs and subscriptions) and the responsibility lies with the member to contact the studio should a different payment method wish to be used.

One 30-day freeze is available with each contract. The studio must be notified prior to utilizing this freeze. Auto pays will continue as scheduled despite the freeze in membership, but the missed time will be allotted to the end of the contract.

With your membership you will acquire the following benefits:

  • 15% off all Mindful Online Gym demand video and transformational Bull and Ballerina cards.
  • 10% off all additional services (private sessions or group classes).
  • FREE Group class passes to gift to a friend/family member per contract year

Terms & Conditions:

The Client (also referred to herein as “you”) agrees to these Terms & Conditions, which are part of the Contract between the Client and MOG.

Fees and Payment:

Payment is due at the time of service or based on the terms for the auto-pay program option. My credit card will be kept on file for billing convenience irrespective of payment method. The card information is secure; it will be used in the event that a client has not paid for an owed session or payment.

Interest On Unpaid Fees:

If any part of your fee remains due and unpaid for 7 days after it is due, you will be in default under this Contract and interest shall accrue on the overdue fee payment, starting on the due date, at the rate of 18% per annum or the highest rate whichever is less, until such default is cured.

Refunds:

There are no refunds for this program, except as otherwise set forth herein.

Length of Your Contract:

You agree to use all of your sessions within the “Use by” term of the package you purchased.  You shall forfeit any unused sessions.

Termination of Your Contract:

MOG may terminate this Contract upon a 30 day written notice to you if you fail to pay any fees when due hereunder. You may terminate this Contract 30 days prior to the last date of the contract as the agreement with a written notice sent to MOG.

Assigning Your Contract Upon Sale:

MOG has the right to assign this Contract to a successor.

Within three (3) days of signing the Contract, you can cancel this Contract as set forth below with MOG (excluding weekends and legal holidays).

 

How to Cancel:

You must cancel the Contract pursuant to this provision within three (3) days of signing it by a written notice, either by mail to MOG.

 

Refund:

Upon receiving your written notice of cancellation pursuant to this provision, MOG will refund all monies paid under the Contract, except for amounts used for sessions that you fulfilled.  The refund will be computed by subtracting from the amount paid the number of used sessions multiplied by the single session rate.

If You Become Physically Unable To Use Our Sessions Physically Unable To Use Sessions:

If you become physically unable to avail yourself of a substantial portion of the services which you used from the start date of the Contract until the time of notice of disability, the buyer can cancel and will be refunded the unused portion of the Contract for which you have paid.

 

How to Cancel:

In order to cancel the Contract pursuant to this provision, you must promptly provide MOG proof of disability. A physical disability sufficient to warrant cancellation of the Contract by you shall be established if you furnish a certification of such disability by a licensed physician to the extent the diagnosis or treatment of the disability is within the physician’s scope of practice. 

Class Structure:

I am aware that all sessions and classes are by appointment only, and payment will be drafted as per agreed.  I can schedule my classes online at https://mindfulonlinegym.com. I understand that if I have not shown up within 20 minutes of my scheduled session and I have not called to say that I am coming I will be charged the full session fee. My instructor is not responsible for staying past 10 minutes. I understand that Mindful Online Gym guarantees appointment times, not instructors. In the case of teacher illness or emergency, another Mindful Online Gym  teacher will be automatically substituted. Mindful Online Gym  will try to notify each client whenever possible. Should you choose to not work with the substitute instructor the 24-hour cancellation policy will apply. 

Termination For Cause:

Mindful Online Gym may terminate your membership for cause if: (1) you fail to make timely payments; (2) the monthly EFT payment or dues are interrupted or discontinued for any reason and you do not provide an acceptable alternative; (3) you fail to follow any of Mindful Online Gym policies or rules or violate any part of this Agreement; or (4) your conduct is improper or harmful to the best interests of Mindful Online Gym or its clients. Termination is effective on the date Mindful Online Gym mails a notice to your last known address, sends an email to the address provided by you for the Mindful Online Gym records, or hand delivers a notice to you. In the event of termination for cause, you shall not be entitled to any refund and you will remain liable for all financial obligations incurred.

Termination Without Cause:

Mindful Online Gym  may terminate your membership without cause or for any reason not stated above. Termination is effective on the date Mindful Online Gym emails a notice to your last known address. In the event of a termination without cause, you are liable for all financial obligations incurred. Future unused and paid dues will be refunded pro-rata.

Community Guidelines

As a participant in our Community, I will:  

  1. LISTEN GENEROUSLY: I am fully engaged and avoid distractions (i.e. cell phones/email/side conversations) when I communicate with Mindful Online students and staff. I am present in my listening and am aware of how my words land with others.  
  2. SPEAK HONESTLY & DIRECTLY: I speak clearly with integrity and positive intentions. I speak about what I know and have the ability to say, “I do not know.” I speak up when I have a contribution or concern, and I do not gossip about those in the community.  
  3. SUPPORT MY COMMUNITY: I empower the Mindful Online Gym community by holding space for its members to reach their fullest potential. I understand that each teammate is responsible for his or her own personal journey, and I allow them the opportunity to be who they are now, not who I think they have been in the past. I attend classes via Zoom and give constructive feedback to my instructors & peers. I make an effort to participate in community events when I am available.  
  4. HONOR MY COMMITMENTS: I believe in and uphold my participation in this program.  
  5. ACKNOWLEDGE & APPRECIATE OTHERS: I value the efforts and contributions made to my community by all Mindful Online staff, instructors, and students. I show my peers respect by allowing them to focus on their work while they are “on the clock,” and show gratitude through my actions and my words.  
  6. EMPOWER & INSPIRE: I actively create and generate the Mindful Online Gym community and give of myself without expecting more in return. I am dedicated to my own growth and know that I empower myself by empowering those around me. I am generous with my community and will share its value with others

Media Release:

I hereby grant MOG (“the organization”) permission to use my likeness in photographs, video recordings, or electronic images, quotes, and feedback in any and all of its publications, including website entries, without payment, royalties or compensation, or any other consideration. I understand and agree that these materials will become the property of the organization and will not be returned. I am 18 years of age or older, and I am competent to contract in my own name.
